家政工人休息时间的法治化

摘要: 家政工人的休息时间制度往往被遮蔽在传统认知之中。为了保障家政工人休息权,实现家政劳动人性化,无论是从家政工人身心健康角度考察,抑或是从国际公约中国化角度分析,都必须制定国家强制性的休息时间规则。基于“家庭关爱型”利益衡平的逻辑,家政工人休息时间制度应当具有基准性、连续性、确定性和灵活性。就我国具体制度而言,体系化的立法应确保家政工人每日至少连续8小时的休息时间,每周至少连续24小时休息时间。对于每周至少一次24小时连续休息时间,立法应许可雇主同家政工人自行协商,于当月内集中休息或分散休息。
