岛屿争端的判定

摘要： 属于国际争端范畴的岛屿争端主要是因为国家间关于岛屿的界定、主权归属及能否作为基点而产生的法律上或事实上的分歧或对立。在这三种岛屿争端中,岛屿主权争端属于陆地领土争端,不是《联合国海洋法公约》调整的对象,也无法用《联合国海洋法公约》的争端解决机制进行解决。我国与周边国家间涉及这三种争端。
