摘要： 修复性司法运用于少年犯罪已成为国际上刑事政策的重要议题,在严罚化及被害人地位提升的趋势下,修复性正义为少年司法提供了另一种面对少年犯罪的典范。许多国家与地区都将修复性司法运用于少年犯罪,且取得了较好的效果。相较传统刑事司法模式,修复性司法更好地考虑到少年、受害人和社区的利益,修复正义比矫正正义更符合程序公平和比例原则的要求。在少年司法中引入修复正义,应坚持少年的最大利益原则,正确理解少年的悔恨与责任,关注少年的社会融合,坚持以促进少年的健全成长为目的,推展我国少年修复性司法在实务中积极、正面发展。
