摘要： 不可避免披露原则是美国法院在长期司法审判实践中逐步确立的一项防止商业秘密被潜在披露的禁令救济原则。实践中该项原则不仅在美国各州之间的发展不平衡, 而且由于其适用过于依赖于法官的自由裁量, 具有一定程度的不确定性。剖析美国商业秘密法不可避免披露原则的历史演变, 可以为我国立法和司法实践提供借鉴和启示。
